Welcome to F.I.L Bev & Co. (fil-bev-and-co.myshopify.com) ("we," "us," "our," or "the Site"). These Terms of Service ("Terms") govern your access to and use of our website, and the purchase of products including coffee beans/ground coffee, loose leaf tea, face masks, gift cards, and any other products we offer.

By accessing our Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 15 years old, or the age of majority in your province/territory or country of residence, to place an order on this Site. By using the Site, you confirm that you meet this requirement.

2. Products & Descriptions

We try to display product information (including images, descriptions, and pricing) as accurately as possible. However:

  • Colours, packaging, and product appearance may vary slightly from what is shown due to photography, screen settings, or batch/harvest variation (particularly for coffee beans and tea leaves, which are natural agricultural products).
  • We do not guarantee that product descriptions or other content on the Site are accurate, complete, current, or error-free. If a product is not as described, your sole remedy is as set out in our Return & Refund Policy.
  • We reserve the right to limit quantities, discontinue products, or refuse any order at our discretion.

3. Pricing & Payment

  • All prices are listed in Canadian Dollars (CAD) unless otherwise stated, and are subject to change without notice.
  • We reserve the right to correct any pricing errors, even after an order has been placed, and will notify you before processing an order affected by a pricing error.
  • Payment is processed securely through Shopify's payment system at checkout. We do not store your full payment card details.
  • You represent that you are authorized to use the payment method provided.

4. Orders & Order Acceptance

Placing an order is an offer to purchase. We reserve the right to refuse or cancel any order for any reason, including but not limited to: product availability, errors in pricing or product information, suspected fraud, or unauthorized/illegal activity. If we cancel an order after payment has been taken, you will receive a full refund.

5. Shipping & Delivery

Shipping timelines and costs will be provided at checkout. We are not responsible for delays caused by shipping carriers, customs, or events outside our reasonable control. Risk of loss and title for products pass to you upon our delivery to the shipping carrier.

6. Food & Consumable Products

Some of our products (coffee, tea) are food items intended for personal consumption:

  • Please review ingredient and allergen information before purchasing, and consult a healthcare provider if you have allergies, sensitivities, or health conditions.
  • Store products as directed on packaging to maintain freshness and safety.
  • We are not liable for adverse reactions resulting from misuse, improper storage, or failure to disclose allergies/medical conditions prior to purchase.

7. Face Mask Products

Face masks sold on our Site are cosmetic/personal care products and are not intended to diagnose, treat, cure, or prevent any disease. Discontinue use and consult a physician if irritation occurs. Always patch-test new products before full use.

8. Gift Cards

Gift cards purchased through our Site are non-refundable and cannot be redeemed for cash, except where required by law. Gift cards do not expire unless required otherwise by applicable law. Lost or stolen gift card codes are your responsibility once delivered.

9. Accounts

If you create an account with us, you are responsible for maintaining the confidentiality of your login information and for all activity under your account. Notify us immediately at bobateaandli@gmail.com if you suspect unauthorized use of your account.

You agree not to:

To the fullest extent permitted by law, F.I.L Bev & Co. and its owner(s) will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products purchased through it. Our total liability for any claim relating to your order will not exceed the amount you paid for the product(s) giving rise to the claim.
